On May 9, 2025, the FTC voted to delay the enforcement deadline of the Negative Option Rule by 60 days. The FTC will now begin enforcement of the rule, which has become known as the “Click to Cancel” Rule, on July 14, 2025. The stated purpose of the rule is to address deceptive and unfair practices in negative option marketing, including recurring subscriptions, automatic renewals, free trials, and continuity plans. One of the key provisions is to make certain promotional offers simpler for consumers to cancel.
ECAC provided a summary of the rule in its earlier article which can be found here: https://ecacusa.org/2024/10/24/negative-option-rule/
